In Texas, the primary method of deed of trust foreclosure is non-judicial, meaning it doesn't involve the judicial system. However, if the deed of trust does not contain power of sale language, the lender may seek judicial foreclosure.  A property owner has 60 days from the time he or she receives a notice of default until the property is sold at a public foreclosure auction sale.
